Terms of Service
Effective from May 1, 2023
1. Introduction
These Terms of Service (the "Terms") govern the rights and obligations between the operator of the ihos.cloud service (the "Provider") and users of these services (the "User").
The service provider is Honza, operator of the ihos.eu project, who is not a VAT payer.
A User is any natural or legal person who uses the Provider's services.
2. Service Description
The Provider offers the following cloud services:
- Virtual Private Servers (VPS)
- Web hosting
- Database services
- Object storage
- Other related services
Some services are provided free of charge, especially for community projects, while others are charged according to the current price list.
3. Registration and Account
Registration and creation of a user account is required to use the services. The User is obliged to provide truthful and complete information and to keep this information up to date.
The User is responsible for protecting their login credentials and must not share them with third parties. Any suspicion of unauthorized access to the account must be reported to the Provider immediately.
4. Payment Terms
Prices for paid services are listed in the current price list. The Provider is not a VAT payer, so prices are final.
Payments are made in advance based on an issued invoice or through an automatic payment system.
In case of payment delay, the Provider is entitled to limit or suspend the provision of services.
5. User Rights and Obligations
The User undertakes to:
- Use services in accordance with these Terms and applicable legal regulations
- Not use services for illegal purposes or to distribute illegal content
- Not endanger the security and stability of the Provider's infrastructure
- Respect third-party intellectual property rights
- Not perform activities that could lead to server or network overload
6. Provider Rights and Obligations
The Provider undertakes to:
- Ensure service availability according to agreed parameters
- Perform regular data backups (if part of the service)
- Inform Users about planned outages and maintenance
- Protect User personal data in accordance with legal regulations
The Provider reserves the right to:
- Change the scope and parameters of provided services
- Adjust service prices
- Limit or suspend services in case of violation of these Terms
- Perform technical interventions in infrastructure to ensure proper service operation
7. Availability and Warranties
The Provider strives to ensure maximum service availability but does not guarantee uninterrupted availability. Planned outages will be announced to Users in advance.
The Provider is not responsible for outages caused by force majeure, third-party attacks, or other circumstances beyond its control.
8. Data Protection
The Provider undertakes to protect User data and handle it in accordance with legal regulations. Details about personal data processing are set out in the Privacy Policy.
The User is responsible for regular backup of their data, unless backup is explicitly part of the agreed service.
9. Service Termination
The User may terminate the use of services at any time but must pay all obligations to the Provider.
The Provider may terminate the provision of services in case of serious or repeated violation of these Terms, without entitlement to refund of already paid fees.
After service termination, User data will be retained for 14 days, after which it will be permanently deleted.
10. Final Provisions
These Terms are governed by the laws of the Czech Republic.
The Provider reserves the right to change these Terms at any time. Users will be informed of changes through the website or email.
If any provision of these Terms is or becomes invalid, the remaining provisions remain in effect.
These Terms take effect on May 1, 2023.
